Know Your Legal Options During Domestic Violence Awareness Month

October is Domestic Violence Awareness Month, a time to shed light on abuse and the legal protections available to victims in Massachusetts. Whether the threat comes from someone in your home or a person outside of it, there are legal tools designed to help you feel safe again.

In Massachusetts, there are two types of protective orders available—each meant for different circumstances. Understanding which one applies to your situation is the first step toward getting help.

1. Domestic Restraining Order (209A Order)

Also known as a 209A Order, this type of protective order is for people who:

  • Are or were married

  • Are in or were in a dating relationship

  • Are related by blood or marriage

  • Live or lived in the same household

A Domestic Restraining Order can require the abuser to stay away from you, leave your shared home, or stop contacting you. It offers powerful protection for those in close or familial relationships with the person causing harm.

2. Harassment Prevention Order (258E Order)

If you’re not eligible for a Domestic Restraining Order, you may still be able to seek protection under a Harassment Prevention Order. This type of order is designed for:

  • Neighbors

  • Co-workers

  • Acquaintances

  • Situations like an ex-wife and a new wife

Harassment Prevention Orders are available when someone is harassing, threatening, or stalking you, even if there is no domestic or familial connection.

How to Get a Protective Order

Protective orders are issued by a judge in court. However, if you’re in immediate danger outside of court hours, a temporary emergency order may be granted by an on-call judge through the police.

Don’t wait to seek help. These orders are legal tools designed to protect your safety—and they can be obtained quickly in urgent situations.
