What you say next can make or break your case.

I’m Mike Consonant, a criminal defense attorney here in Boston, Massachusetts. Over the years, I’ve helped countless people charged with OUI and DUI after routine traffic stops went sideways all because they didn’t know what to say or what NOT to say.

In this video, I’m breaking down the four biggest mistakes people make during a DUI stop and what you should do instead to protect your rights. These are the things police don’t want you to know, because once you understand them, you stop helping them build a case against you.

Here’s what you’ll learn:

What to say when asked, “Have you been drinking tonight?”
(Hint: honesty isn’t always your best defense.)

Why even small talk can hurt you later.
Officers write reports after the fact, and your words are rarely quoted verbatim.

How “Do you mind if I look in your car?” is not just a question—it’s a test.
Learn how to refuse a search without being confrontational.

Why arguing or getting defensive only makes things worse.

🧠 The Truth About DUI Stops

Massachusetts law is clear: anything you say can and will be used against you. The line between being polite and giving up your rights is razor thin. Police are trained to ask questions designed to make you talk—and the more you talk, the more evidence you hand them.

Even saying something as simple as “I only had one drink” gives them cause to pull you out of the car and start a field sobriety test. From there, it’s a short trip to an arrest, a breath test, and a criminal charge that follows you for years.

That’s why the smartest move is to stay calm, be respectful, and say as little as possible. Your silence isn’t guilt, it’s strategy.

🛑 The Four Things You Should NEVER Do During a DUI Stop:

Don’t admit to anything.
You’re not required to answer questions like “Have you been drinking?” or “Do you know why I stopped you?” The safest answer is:

“Officer, I prefer not to answer any questions.”
That’s polite, lawful, and it cannot be used against you.

Don’t volunteer extra information.
Skip the explanations about where you’re coming from or how many drinks you had. The more you say, the more they can twist your words.

Don’t consent to searches.
Saying “Sure, go ahead” waives your Fourth Amendment rights. Politely respond,

“I do not consent to any searches.”
No attitude. No sarcasm. Just calm and firm.

Don’t argue or get confrontational.
Police are trained to escalate when challenged. Remember, you’re not arguing with the officer; you’re performing for the camera. Your calm demeanor will do more for you in front of a jury than anything you could say on the roadside.

⚖️ Why This Matters

Once you start talking, you’re filling in the blanks of the prosecutor’s story. But if you stay silent, you give your attorney the chance to challenge the stop, the officer’s observations, and the evidence.

Your silence is your shield. It’s not disrespect, it’s defense.
